摘要
在我国侦查程序中,侦查机关拥有强大的权力,而且缺乏有效的制约,往往致使犯罪嫌疑人的合法权益受到侵犯,在侦查中,刑讯逼供等违法现象屡禁不止。为此,笔者建议法官以中立的身份介入侦查,构建我国的司法审查机制。
In our country,investigative organization has strong power in procedure of investigation.But this power has not been restricted effectively,which often infringes the interest of criminal suspect,such as exacting a confession by torture and other violation of law.In order to solve the problem,in this article the author puts forward the suggestions that judge take part in the investigation impartially and then judicial review on investigation be constructed by this way.
