社会危害性是不是犯罪的本质特征,有没有必要继续在犯罪概念中继续存在下去,受到许多学者的质疑。本文从哲学的角度分析了社会危害性仍是犯罪的本质特征,认为从犯罪概念的历史发展和其功能上考察,社会危害性必须在犯罪概念中加以规定。
