依法行政价值缺失的宪政思考——从行政立法视角看

Speculation on the Loss of the Goal in Government by Law——From the Aspect of Administrative Legislation

保障公民权利是依法行政的价值取向,但依法行政实践因行政立法的原因背离其价值。而完善行政立法来推进依法行政受到现行宪政体制的约束,要突破现行宪制的困扰实现依法行政只有加强行政立法程序控制和实行行政立法诉讼。

To protect people's rights is the goal of government by law, but the goal can't be realized under our present constitutional construction. To realize the government by law, we should intensify the procedural control of administrative legislation and carry out suit of administrative legislation.
