浅析商业秘密权的权利特征及其权利限制

保护商业秘密是各国立法所关注的问题 ,对商业秘密这一权利的相关研究由来已久 ,国内外学者众说纷纭 ,可以说是见解各异。本文主要基于其应定位于知识产权范畴的观点 ,从商业秘密权的权利特征及其权利限制两方面进行了分析探讨 。

Each country pays more and more attention to protecting business secret.It has been long time since the right of the business secret was researched.A lot of different opinions occurred between the scholars home and abroad.Mainly based on the viewpoint that the business secret should be sited in the category of intellectual property,this paper discussed and analyzed the right of the business secret from its characteristics and limitations aspects.Thereby,I hope relative units have enough recognition to their business secret.
