加入WTO对我国体育立法的影响

Influence of China's Reentry into WTO on Sport Legislation

通过对《服务贸易总协定》关于对成员方在服务贸易方面的规定和当前我国体育立法现状的分析,提出了我国加入WTO,将对体育立法产生很大影响。我们应加强以下几方面的立法工作,以确保体育服务业迅速发展:(1)体育服务市场准入和市场监督;(2)体育产权界定;(3)充分利用《服务贸易总协定》中的例外条款等,制定保护我国体育服务业的措施;(4)政府对体育服务业的优惠政策等;(5)制定有关体育无形资产的保护法;(6)加强体育法律编篡工作。

By analyzing the concerned provisions in GATS and current sport law of our country, the paper discusses the influence of China's reentry into WTO on sport legislation of our country. And we should strengthen the following sport legislation to ensure the rapid development of sport services: (1) access to market and supervision of market; (2) the definition of sport property; (3) protective regulations of sport industry;(4) the preferential policies about sports services; (5) protection of sport intangible property and (6) compilation of sport law and regulation.
