A Probe into the Right of Dwelling

居住权是在他人的房屋所有权上设立的一种用益物权,居住权人对他人所有的房屋及其附着物享有占有、使用乃至收益的权利。居住权以其特有的物权效力对财产所有权的归属与财产的利用权进行分配,有利于发挥房屋效用、实现对房屋的最大化和用,也有利于保护弱势群体,因而其制度的确立十分必要。

The right of dwelling, one kind of usufructary right established on the basis of other' s ownership of house, means that the dweller can possess and make use of other' s house and the adhesive installations for dwelling. The right of dwelling is useful in improving the effectiveness of house and realizing the optimum use of the house. Also it is helpful to protect the weaker groups. Therefore, it is necessary to set up the system on the right of dwelling.
