我国的政党立法问题探析

An Inquiry into Legislative Issue on Political Party in Our Country

我国实行共产党领导的多党合作和政治协商制度。在依法治国的条件下,有必要根据宪法对我国的政党和政党制度问题所作的原则性规定,制定一部专门的政党法,依法规范执政党和参政党的活动。我国政党法的结构应体现中国特色,并在实践的基础上不断完善。从中国的国情出发,政党法应明确禁止任何组织或者个人在中国大陆组建新的政党。

Our country practises the system of multiparty cooperation and political consultation under the leadership of CPC.Under the condition of governing the country according to law,it is necessary to formulate a special law of political party based on the provision in principle of constitutional law about political party and institution of political party in our country by which the activities of the ruling party and the party participaitng in politics can be standardized according to law.The structure of Chinese law of political party should embody Chinese characteristics and should be continuously perfected.Starting from national conditions of China,the law of political party should explicitly prohibit any organization or individual from organizing new political party in Chinese mainland.
