论我国水资源产权的界定

The Definition of Water Right in China

水资源的特殊自然和经济属性使得水资源稀缺出现并提出了明晰界定产权的要求。随着水资源紧缺的日益加剧 ,我国现有的基于行政手段配置水权的共有水权制度安排已不能有效地配置水资源 ,在实践中严重阻碍了水资源的市场化。因而 ,我们应当借鉴国外立法经验 ,提高共有水权的排他性 ,明晰水权 ,引入市场机制 ,建立符合经济发展的水权和水市场制度。

With special natural and economic character,water resources become scarce and require definite boundary of water right.Now,we have already formed a set of system arrangement of common water right which is based on the government distribution. But with the obvious scarcity of water resources,the system will no longer allocated it effectively and hindered the market seriously in the practice. Consequently,we should learn the experience from other countries, enhance the exclusive common right,define the boundary,build water right market and establish water right and water market system being consistent with the development of economy.
