论我国财产征用的宪法缺陷

On the Imperfection of Constitution of the PRC on the Requisition of Private Property by the State

财产征用历来被视为重大宪法问题。我国现行宪法对财产征用制度的规定,由于受计划经济体制和宪法理论与实践不发达的影响,存在重大缺陷:征用概念要件缺失;何为“公共利益”尚无明确界定;征用范围过于狭窄;没有补偿原则的外在限制。这些缺陷严重影响了对财产权的限制和保护。必须通过进一步修改宪法和实现宪政民主予以克服。

Requisition of private property is regarded as an important matter of constitution. The present constitution in China has great imperfection in establishing the system of requisition of private property because of the influence of the planned economic system and the imperfection of constitution. Such imperfection as deletion of the main document of requisition, unclear definition of 'public interests', narrow scope of requisition and no limit to the principle of compensation make serious influence to the limit and protection of property right, which must be overcome by revise the constitution.
