通过对德国古典哲学的批判继承,马克思的法哲学思想有了极大的改变与提升。《莱茵报》期间,马克思与黑格尔具有同样的观点:国家的本质可以看作是普遍的。随着马克思思想的进一步升华,在《黑格尔法哲学批判》中,马克思明确指出黑格尔阐述的国家与市民社会之间的关系存在缺陷,国家的本质是个人,在国家建设过程中坚持民主法治的治国原则,主张建构行政权与立法权相统一的国家体系。《批判》一书中有关法哲学的思想对于当代建设民主法治国家具有重要的启示。

With the further sublimation of Marx’s thought, in the critique of Hegel’s philosophy of law, Marx clearly pointed out that there are defects in the relationship between the state and civil society described by Hegel. The essence of the state is the individual. In the process of national construction, he adhered to the principle of democracy and rule of law, and advocated the construction of a national system with the unity of administrative power and legislative power. The thought of legal philosophy in criticism has important enlightenment for the contemporary construction of a democratic country ruled by law.
