摘要
外卖行业作为电子商务下餐饮电商的一部分,成为一种新的生机和活力的经济形态。迅猛发展的网络订餐服务不只是给人们的生活带来了便利,带来的还有行业里的鱼龙混杂、食品卫生安全得不到保障的“乱象”。文章在分析外卖行业现有法律规制不足的基础上,提出应明确广告经营者、发布者的法律责任,建立监管机关与外卖服务平台之间的信息互通制度,以及加强行政机关对外卖行业食品安全的主动监管等完善建议。
The take-out industry is a part of the catering e-commerce under the e-commerce, and has become a kind of new vigor and vitality of economic form. The rapid development of online meal ordering service not only brings convenience to people’s life, but also brings the industry of mixed food hygiene. This paper analyzes the deficiency of existing laws and regulations in the take-out industry, and puts forward that we should make clear the legal responsibility of advertisement operator publisher, establish an information exchange system between regulatory authorities and delivery service platforms, and strengthen the administrative organs to the industry food safety of active supervision and other improvements.
