论互联网审判中的送达问题

摘要 送达是民事诉讼中的关键问题,而送达难向来是法院审判过程中无法忽视的一大难题。随着立案登记制度的实施,法院受理案件的数量急剧增加,这个问题也愈发变得突出。然而,杭州、北京、广州等一批互联网法院相继成立,其对电子送达方式的探索,让人们看到了解决送达难问题的希望。本文基于互联网法院在送达方面的实践,对于送达中的“同意”机制、民事诉讼法有关电子送达的相关条款、互联网法院的现实运作进行了较为深入的探讨,并提出前置“同意”、默示“同意”,优化专业人员配置,完善《民事诉讼法》中有关电子送达的内容等建议,以期为互联网法院的发展提供些许参考。 Service, as one of key issues in civil litigation, has always been a major difficulty that cannot be ignored in the court trial process. With the implementation of the registration system, the number of cases accepted by the courts has increased dramatically, which turns out to be a serious problem. However, hope of solving the service problem is seen, as a number of Internet courts such as Hangzhou, Beijing and Guangzhou are set up one after another, and start to explore the service mode. Based on the practice of Internet courts in service, this paper discusses the “consent mechanism” in service, the relevant provisions of the Civil Procedure Law on electronic service, and the practical operation of Internet courts, and also puts forward the construction of “consent in advance”, “implied consent”, optimized the allocation of professionals, and improved the content of electronic service in the Civil Procedure Law, in order to provide some reference for the development of Internet courts.
