摘要
随着科技的不断发展,互联网大数据技术的发展也越来越成熟,运用大数据的分析技术被广泛的应用到各个领域中。大数据分析技术在电子商务领域可以给用户带来方便快捷的搜索体验,定制个性化的商品和服务,但由此而生的大数据“杀熟”行为也应运而生,损害用户合法权益的同时还给广大用户带来了恐慌。所以大数据“杀熟”行为是否需要规制,该如何规制都是需要解决的问题。大数据“杀熟”行为所涉及到的法律众多,本研究从反垄断法的价格歧视角度出发,研究大数据“杀熟”行为给社会带来的危害,并提出了如何通过反垄断法对该行为进行规制。
With the continuous development of science and technology, the development of Internet big data technology is becoming more and more mature, and the analysis technology using big data has been widely applied in various fields. Big data analysis technology in the field of e-commerce can bring users convenient and fast search experience, customized goods and services, but the resulting big data “kill ripe” behavior also arises at the right moment, which damages the legitimate rights and interests of users and also brings panic to the majority of users. Therefore, whether and how to regulate the behavior of “killing ripe” of big data is a problem that needs to be solved. There are many laws involved in the behavior of “killing the ripe” of big data. From the perspective of price discrimination of anti-monopoly law, this study studies the harm of “killing the ripe” of big data to society, and puts forward how to regulate this behavior through anti-monopoly law.
