元宇宙中专利权主客体之辨

The Distinction between the Subject and Object of Patent Rights in the Metaverse

元宇宙这一发展的如火如荼概念,为发明创造提供了更广阔的空间,同时也为专利权主客体的界定带来了挑战。文章通过文献研究和案例研究法,结合元宇宙发展现状,分析元宇宙中自然人、虚拟人及智能机器人的地位,探讨虚拟物的专利权保护途径,增加准专利权客体的可能性,分析其内涵,并对具体保护路径提出建议。希望文章所提出的解决问题的构想可以给研究相关问题的研究者提供一些借鉴。

The concept of the metaverse is in full swing, which provides a broader space for invention and creation, but also brings challenges to the definition of the subject and object of patent rights. Through literature research and case study methods, combined with the development status of the metaverse, this paper analyzes the status of natural persons, virtual humans and intelligent robots in the metaverse, discusses the patent protection methods of virtual objects, increases the possibility of quasi-patent objects, analyzes its connotation, and puts forward suggestions on specific protection paths. It is hoped that the ideas proposed in this paper can provide some reference for researchers who study related problems.
