审思与回应:网络游戏直播著作权问题研究

摘要 网络游戏产业所呈现出的迅猛发展态势,激发了相关市场的热情活力,游戏直播行业也由此应运而生。网络游戏种类纷繁复杂,游戏直播主体多样,所对应的游戏直播画面的可版权性与归属也各不相同,实务上对此各执一词,一方面,个人直播者在直播过程中形成的语言、动作、模式、乃至画面本身都可能形成个性思想的特殊表达具有独创性,可定性为录音录像制品或是独立作品,享有邻接权。另一方面,网络竞技赛事直播由于凝结多工种多部门的智力劳动成果,可定性为类电影作品,享有相对应的版权。在明确性质问题的基础上,还需要通过完善立法、制定行业规则等可能措施,有效促进游戏直播行业健康发展。 The rapid development of the online game industry has stimulated the enthusiasm and vitality of the related market, and the game live broadcasting industry has emerged as a result. The online game types are complicated, the game live subject is diverse, corresponding to the game live screen copy right ability and attribution are also different, the practice of this each argument, on the one hand, the individual live in the process of the formation of the live language, action, mode, and even the screen itself may form a special expression of individuality of the idea of originality, can be characterized as a phonogram or independent works, enjoy neighboring rights. On the other hand, the live broadcast of network athletic events can be characterized as film-like works and enjoy corresponding copyrights due to the fact that it condenses the intellectual labor achievements of multiple work types and sectors. On the basis of clarifying the nature of the problem, it is also necessary to effectively promote the healthy development of the game broadcasting industry by improving legislation, formulating industry rules and other possible measures.
