建立一个公平有限的行政诉讼制度是法治精神的内在要求。它不仅仅是宪法控权理念的展开,而且对行政权力的制约和公民权利的保障。各国在对待行政诉讼起诉与受理的关系时具有很多普遍性的规定,但由于行政诉讼产生的历史背景不同,各国对此问题仍具有特殊性。我国的行政诉讼有关制度也从无到有、由缺乏到全面的发展起来,如今正在渐渐的接近完善,然而,好像任何处于新生代的事物所遭受的到的境况一样,这个过程也是充满了疑辩和争论,但恰恰是疑辩和争论来创造一个砥砺、共进的平台。有必要以这样的一个展示平台,对行政诉讼中的立案、起诉、受理等基本概念作以分析,同时对立案后的法律后果作以探究。研究目的:研究我国行政诉讼起诉与受理制度的构建现状,存在的问题以及怎样建立一个公平有效的制度模式。研究内容:研究制度存在的问题。提出有效的保障公民行使权利对症下药的措施。
