互联网背景下民事诉讼效率的提升路径研究

诉讼效率是民事诉讼的基本价值目标,诉讼效率低下会直接影响当事人权利的行使和保障,动摇人们对司法制度作为纠纷解决功能的信任。我国司法实践中诉讼效率低下现象比较突出。鉴于此,我国曾通过增加法官人数、提高法官素质以及完善民事诉讼程序的方式来提高民事诉讼效率,虽取得了一定的效果,但暴露出的一些问题却无法解决。随着互联网信息技术飞速发展,为提高民事诉讼效率带来了前所未有的机遇,运用互联网信息技术成为提升民事诉讼效率的重要方式。本文根据立案、在线调解、举证与质证、庭审四个环节目前的现状及问题,提出切实可行的提升我国民事诉讼效率的互联网路径。

Litigation efficiency is the basicvalue goal of civil litigation. Low litigation efficiency will directly affectthe exercise and protection of the parties’ rights and shake people’s trust inthe judicial system as a dispute resolution function. In China’s judicialpractice, the phenomenon of low litigation efficiency is quite prominent. Inview of this, China has increased the number of judges, improve the quality ofjudges and improve the civil procedure to improve the efficiency of civillitigation, although it has achieved certain results, but some problems exposedcannot be solved. With the rapid development of Internet informationtechnology, it has brought unprecedented opportunities to improve the efficiencyof civil litigation. The use of Internet information technology has become animportant way to improve the efficiency of civil litigation. According to thecurrent situation and problems of filing, online mediation, proof and cross-examination,court trial, this paper puts forward a feasible Internet path to improve theefficiency of civil litigation in China.
