摘要
我国《海商法》采用的是《海牙规则》中的承运人适航义务期间,即“船舶开航前和开航当时”,而《鹿特丹规则》将这一期间扩大到“船舶开航前、开航当时和航程中”。在此次《海商法》修订的背景下,《修订征求意见稿》也提出了对承运人适航义务期间的修改建议,一方面不改变国际海上货物运输合同中承运人适航义务期间,另一方面新增国内水路货物运输合同中承运人适航义务期间为“船舶开航前、开航当时和航程中”。
China’s Maritime Law adopts theperiod of carrier’s seaworthiness obligation in Hague Rules, namely before andwhen the ship sails, while Rotterdam Rules extends this period to before, atand during the voyage of the ship. Under the background of the maritime lawrevised, maritime law revised draft also makes suggestions on revising theperiod of carrier’s seaworthiness obligation, which are keeping the period ofcarrier’s seaworthiness obligation in the contract for the carriage of goods bysea and adding the period of carriers seaworthiness obligation for “before theship sailing, shipment at that time and voyage” in the domestic waterway cargotransportation contract.
