国际货物多式联运合同诉讼管辖权研究

Study on Jurisdiction over Disputes over International Multimodal Transport Contracts

随着全球经济日益快速发展,国际货物多式联运这种新兴的独立运输方式在全球运输领域内地位不断上升,但由此合同纠纷引起的一系列法律问题也随之而来。其中的首要问题便是国际货物多式联运纠纷的管辖法院在司法实践中如何确定。本文分为四个部分:第一部分介绍国际货物多式联运合同概述界定和构成要件;第二部分对国际货物多式联运的现状以及存在的问题进行分析;第三部分阐述分析现阶段国内立法以及司法实践中如何确定管辖权;在前文分析的基础上,第四部分有针对性地提出如何进一步优化该类纠纷的管辖权的建议,以期能够为我国统一规范国际货物多式联运合同纠纷诉讼管辖权的确定提供一些新思路。

With the increasingly rapiddevelopment of the global economy, the new independent mode of internationalmultimodal transport of goods is gaining prominence in the global transportarena, but a number of legal issues arise as a result of contractual disputes.The first and foremost issue is how to determine the competent court injudicial practice for international multimodal transport disputes. This paper is divided into four parts: the first partintroduces the definition and elementsof the international multimodal transport contract;the second part analysesthe current situation and problems ofinternational multimodal transport;the third part explains and analyses howjurisdiction is determined in domestic legislation and judicial practice atthis stage;on the basis of the previous analysis, the fourth part puts forwardtargeted suggestions on how to further optimize the jurisdiction of suchdisputes. On the basis of the foregoing analysis, the fourth part puts forward proposals on how to further optimize thejurisdiction of such disputes, with a view to providing some new ideasfor the unified regulation of the determination of the jurisdiction oflitigation in disputes over international multimodal transport contracts.
