持续侵害状态是否适用正当防卫研究——以传销组织持续侵害的防卫案为视角

Research of Whether the State of Persistent Aggression Applies to Justifiable Defense—Taking Pyramid Selling Organization Cases for Example

被困于传销组织的被害人处于持续性不法侵害之中,传销组织的不法侵害具有难以获得外力救济、不法侵害时间和暴力程度具有可变性、行为联系密切、行为侵害的对象相同以及具有统一概括或连续故意的特征。针对该不法侵害实施的防卫行为在司法实践中的认定存在分歧,法院从防卫前提、防卫时间以及防卫限度角度否定被告人构成正当防卫。对此从这三点进行回应和分析,认为将持续侵害视为整体存在不法侵害,防卫人的防卫适时且防卫行为未明显超过必要限度。

The victims trapped in pyramid selling organizations are in the continuous illegal infringement, the illegal in-fringement of pyramid selling organizations is difficult to obtain external relief, the time of illegal infringement and the degree of violence are changeable, the behavior is closely related, the object of the behavior is the same, and the behavior has uniform generalization or continuous intent. In judi-cial practice, there are differences in the identification of the act of defense against the unlawful in-fringement. The court denies the defendant’s justifiable defense from the perspective of defense premise, defense time and defense limit. Actually the continuous infringement should be regarded as an illegal infringement as a whole. Also the defender’s defense is timely and the defense behavior does not obviously exceed the necessary limit.
