The Path of Intellectual Property Protection for Computer Software

计算机软件被纳入知识产权保护体系有历史和时代背景。在以版权为主的保护路径主导之下,其立法与司法的指导与实践也不断影响着专利权路径对待计算机软件的保护态度与范围。在两种主流保护路径之外,本文主张通过商业秘密复合版权的路径为计算机软件提供更为完善的保护。

The inclusion of computer software into the intellectual property protection system has a historical and contemporary background. Under the dominant protection path of copyright law, its legislation and judicial guidance and practice have also continuously influenced the protection attitude and scope of computer software under the patent law path. In addition to the two mainstream protection paths, this paper advocates that the protection of computer software should be provided through the path of trade secret compound copyright law.
