我国农村恶势力犯罪研究

Research on the Crime of Evil Forces in Rural China

2018年开始,全国上下从“打黑除恶”转变为“扫黑除恶”,一字之差充分反映了国家对恶势力犯罪的打击力度之深、范围之广、影响之大。文章的第一部分对恶势力及其相关的基本概念作出厘清,这是研究恶势力犯罪的基础;第二部分结合实际,对我国广大农村地区的恶势力存在的原因和特征进行分析,发现恶势力犯罪是一种危害力极强、影响极其恶劣的犯罪。我国现阶段对于恶势力犯罪的法律法规还存在漏洞;第三部分,在前两个部分的分析基础之上,分析了我国法律现阶段对于恶势力犯罪的法律法规的不完善之处;第四部分,在第三部分的研究基础之上,提出了相应的完善策略,严惩恶势力的“保护伞”,发扬法治文化,形成法治思维,为我国完善恶势力犯罪的相关法律法规提供一些有益的思考。

Since 2018, the whole country has changed from “cracking down on evil forces” to “sweeping away evil forces”, which fully reflects the depth, scope and impact of the country’s crackdown on evil forces. The first part of the article clarifies the basic concepts of evil forces and their related ones, which is the basis for studying the crimes of evil forces;The second part analyzes the causes and characteristics of the existence of evil forces in the vast rural areas of our country in light of actual conditions, and finds that the crime of evil forces is a crime with extremely strong harm and extremely bad impact. At this stage, there are still loopholes in China’s laws and regulations on crimes committed by evil forces;The third part, on the basis of the analysis of the first two parts, analyzes the imperfections of China’s laws and regulations on the crimes of evil forces at this stage;In the fourth part, on the basis of the research of the third part, the corre-sponding improvement strategies are proposed, the “umbrella” of severely punishing evil forces is proposed, the culture of rule of law is promoted, the thinking of rule of law is formed, and some useful thinking is provided for China’s improvement of relevant laws and regulations on evil forces’ crimes.
