论网络版权领域区块链电子存证问题——以侵害信息网络传播权纠纷为例

On the Block-chain Electronic Storage Problem in the Field of Network Copyright—Taking the Infringement of the Right of Information Network Trans-mission Dispute as an Example

2020年以来,三大互联网法院逐渐在网络版权纠纷中承认区块链电子存证的真实性,区块链技术在网络版权领域不断发挥作用。但同时也产生了许多问题。笔者以互联网法院审理的信息网络传播权侵权纠纷中的典型案件为例,探讨网络版权领域区块链电子存证的相关问题。例如关于作品独创性的认定、著作权权属问题、网络版权侵权行为的认定以及侵权赔偿数额的计算方式等方面,希望能够为我国在区块链技术在司法领域的创新发展助力。

Since 2020, the three major Internet courts have gradually recognized the authenticity of the blockchain electronic storage certificates in the online copyright disputes, and the blockchain technology has been playing a continuous role in the field of online copyright. But there are also many problems arising. The author takes the typical cases in the infringement dispute of the right of information network communication heard by the Internet court as an example to discuss the relevant issues of the blockchain electronic storage cer-tificate in the field of network copyright. For example, in terms of the identification of the originality of works, the issue of copyright ownership, the identification of online copyright infringement, and the calculation method of the amount of infringement compensation, we hope to help the innovation and development of blockchain technology in the judicial field in China.
