行政处罚是维护行政管理秩序的有效手段。乡镇人民政府、街道办事处在维护基层政权稳定和促进基层法治化建设中起着重要作用。新修订《中华人民共和国行政处罚法》相关内容的修改,有效回应了我国基层执法实践中的难题,提升了基层治理的法治化水平。但在实践操作中仍然存着在一些瓶颈,如下放主体和下放事项规定的较为笼统、基层政府的承接能力亟待提高、部分基层政府的执法行为不规范等等,需要通过发挥地方政府的灵活性、强化基层政府承接能力、建立科学的监督机制等有效路径来保障权力下放的科学性和合理性,从而促进我国基层法治化进程和法治政府的建成。

Administrative punishment is an effective means to maintain the administrative management order. Township people’s governments and sub-district offices play an important role in maintain-ing the stability of grass-roots political power and promoting the construction of grassroots rule of law. The revision of the newly revised Administrative Punishment Law of the People’s Republic of China effectively responds to the difficult problems in grass-roots law enforcement practice in China and improves the level of rule of law in grass-roots governance. But some bottlenecks still exist in practice, the subject and delegate matters are more general, grassroots government to undertake ability to improve, part of the grassroots government law enforcement behavior irregularities, etc., need to play through the ability of local government flexibility, strengthen the grassroots govern-ment to undertake, establish a scientific supervision mechanism and other effective path to ensure decentralization is scientific and reasonable, so as to promote the process of grassroots government and the rule of law.
