摘要
新修订的《行政处罚法》第48条为行政处罚决定公开提供形式合法性的同时,对其公开范围作出了一定的限制。但出于行政主体对行政处罚决定公开的功能理解存在偏差、制度供给不足等原因,实践中的行政处罚决定公开仍存在着地区标准有所差异、容易侵犯个人隐私、面临功能异化的风险等诸多现实问题。建议明确制度功能,引入行为标准,进一步界定“具有一定社会影响”,明确比例原则、区分处理原则的适用,从而更好地规范行政处罚决定公开活动,实现其法律效果和社会效果的统一。
Article 48 of the newly revised “Administrative Punishment Law” provides formal legitimacy for the disclosure of administrative punishment decisions, and at the same time makes certain restrictions on the scope of its disclosure. However, due to the deviation of the administrative subject’s understanding of the function of the disclosure of administrative penalty decision and the lack of system supply, there are still many practical problems in the practice of the disclosure of administrative penalty decision, such as differences in regional standards, easy invasion of personal privacy, and the risk of functional alienation. It is suggested to clarify the function of the system, introduce behavioral standards, further define the “having a certain social impact”, and clarify the application of the principle of proportionality and the principle of differentiation, so as to better regulate the public activities of administrative penalty decisions and achieve the unification of their legal and social effects.
