帮信罪电子数据取证问题研究

帮信罪作为我国电信网络诈骗犯罪链条上的第一罪,其电子数据取证过程在技术性和合法性两方面所存在的问题具有代表性。当前,帮信罪电子数据取证存在取证措施性质不明、涉案电子数据海量化、电子数据呈现形式纸质化、证据种类归属不明的现象,导致电子数据真实性和合法性难以质证、取证困难等问题。基于此,应当在现有取证规则的基础上,明确电子数据取证措施的性质、证据种类的区别关键、规范取证方法以及进一步探索区块链技术在刑事司法领域的应用,以解决实践难题。

As the primary offense in the chain of telecommunications and internet fraud crimes in China, the crime of assisting in the commission of fraudulent activities through electronic means represents significant challenges in both the technical and legal aspects of electronic data forensics. Currently, there are issues regarding the unclear nature of forensic measures, the massive volume of electronic data involved, the paper-based presentation of electronic data, and the ambiguity in attributing evidence types, making it difficult to establish the authenticity and legality of electronic data and to gather evidence effectively. Based on these challenges, it is necessary to clarify the nature of electronic data forensic measures, differentiate evidence types, regulate forensic methods, and further explore the application of blockchain technology in the field of criminal justice to address these practical issues.
