Study on the Obligation of Intergenerational Support

《民法典》对于祖孙之间的扶养义务规定较为模糊,学界研究阙无。《民法典》扶养法以父母子女之间的扶养义务为基本框架,以未成年保护为出发点,因此在适用1074条时需要类推父母子女之间的扶养义务。另外,我国通说认为祖孙之间的扶养义务,无论是顺位还是内容,都次于父母子女之间的扶养义务,在“老龄化社会”“失独父母”“三胎政策”等现实情景中,笔者认为应当适当扩大祖孙之间的扶养义务。

The provisions of the Civil Code on the obligation of intergenerational support are relatively vague, and there is almost no academic research. The maintenance law of the Civil Code takes the maintenance obligation between parents and children as the basic framework and the protection of minors as the starting point, so it is necessary to draw analogy to the maintenance obligation between parents and children when applying Article 1074. In addition, China’s general theory believes that the intergenerational support, whether in order or content, is inferior to the maintenance obligation between parents and children, and in the realistic scenarios of “aging society”, “elderly people who lost their only child” and “three-child policy”, the author believes that the obligation of intergenerational support should be appropriately expanded.
