设区的市地方立法权运行实证研究

Empirical Study on the Operation of Local Legislative Power in Cities with Districts

2015年3月15日,《中华人民共和国立法法》作出修改,赋予了所有设区的市地方立法权。在设区的市获得地方立法权后,面对行使地方立法权的新机遇、新挑战,如何运行好地方立法权,提升地方立法质量,立良法,出精品,成为新获得地方立法权的市面临的重大实践课题。笔者结合鹤壁市立法实践,以合法性标准、地方特色标准、可操作性标准、社会实效性标准、技术性标准为导向,剖析当前新获得地方立法权的市出现的行政部门起草下的利益化、缺乏地方特色的立法重复化、语体风格上的文学化、政策化、口语化倾向等问题,进而提出优化地方立法权运行的重要路径。通过推进专业化立法、精细化立法、实效性立法,让设区的市立法工作站上新高度,为推动地方治理体系和治理能力现代化提供坚实的法治保障。

On March 15, 2015, the Legislative Law of the People’s Republic of China was amended to give all cities with districts local legislative power. After the cities with districts gained local legislative power, facing the new opportunities and challenges of exercising local legislative power, how to run the local legislative power, improve the quality of local legislation, make good laws, and produce fine products, has become a major practical issue faced by the cities with newly gained local legislative power. Combined with the legislative practice of Hebi City, the author takes the criteria of legality, local characteristics, operability, social effectiveness, and technical standards as the guide, analyzes the problems such as interests under the drafting of the administrative departments, the repetition of legislation lacking local characteristics, the tendency to literary, policy, and colloquialism in the style of language and then puts forward important paths to optimize the operation of local legislative power. By promoting specialized legislation, refined legislation and effective legislation, the legislative work of cities with districts will stand at a new height and provide a solid guarantee of the rule of law to promote the modernization of the local governance system and governance capacity.
