摘要
随着互联网经济的迅速发展,互联网平台企业对劳动力的需求促进了闲置劳动力在社会运行过程中的参与。网约工是时代的产物,是当今新时代工种的有效补充,为大众就业提供时代特征鲜明的新思路。同时,其权益保障的问题应运而生。本文指出的现存的困境主要围绕效率、薪酬、人身安全、社会保障等方面,个中原因主要集中于如何认定劳动关系平台商业模式的负面影响、劳工权益保护不足等方面。相对应的从三个角度进行应对:一是确立劳动关系认定的三分法;二是规范大数据分析下零工从业者的职业技能培训体系;三是激励平台端建立健全相应的劳动保障措施。
With the rapid development of the Internet economy, the demand for labor by Internet platform companies has promoted the participation of idle labor in the social operation process. Online contract work is a product of the times, an effective supplement to the types of work in the new era, and provides new ideas with distinctive characteristics of the times for public employment, and at the same time, issues regarding their rights protection have emerged. This article points out that the existing difficulties mainly revolve around efficiency, compensation, personal safety, and social security, among other aspects. The reasons behind these difficulties mainly focus on how to identify the negative impact of the labor relationship platform business model and the insufficient protection of labor rights. Correspondingly, three approaches are proposed: first, establish a tripartite method for determining labor relationships;second, regulate the vocational skills training system for gig workers under big data analysis;third, incentivize platforms to establish and improve corresponding labor protection measures.
