网络游戏行业迅速崛起的同时,游戏相关的著作权问题也随之增加,其中有关游戏地图的侵权纠纷也在司法实践中逐渐增加,其核心问题在于游戏地图作品属性的认定。在FPS游戏中,游戏地图具有不可否认的重要意义,从其制作过程和本质功能出发能够为判定其作品属性提供有益思路。场景地图发挥指示玩家位置的实用性功能和呈现美术效果的艺术性功能,具备图形作品和美术作品的双重属性,而平面缩略图在满足独创性要求的前提下能够构成图形作品。
With the rapid rise of the online game industry, the copyright issues related to the game are also increasing, and the infringement disputes about game maps have gradually emerged in judicial practice, in which the core problem lies in the identification of the attributes of game maps. In FPS games, game maps are of undeniable significance, and it is helpful to analyze its attributes from the perspective of its production process and essential functions. Scene map plays the practical function of indicating the location of players and the artistic function of presenting art effects, and has the dual attributes of graphic works and art works, while plane thumbnails can constitute graphic works on the premise of meeting the requirements of originality.
