摘要
随着经济社会和医疗事业的发展,人们对院前急救服务的要求也越来越高。2022年5月,河南大学一大三女生因“120延误派车”错过了最佳的急救时间,最终因脑出血去世。该事件引发了社会对院前急救服务质量的担忧。本文尝试以事件本身入手,结合当前我国院前急救领域的立法现状,分析院前急救行为的法律个性,探讨急救中心与患者之间的关系,旨在提出建立新的行政监管模式,从而有效提升院前急救服务质量。
With the development of economy, society and medical undertakings, people’s requirements for pre-hospital emergency services are getting higher and higher. In May 2022, a junior female student at Henan University missed the Golden First Aid Time due to “120 delay in dispatching a car”, and finally died of a cerebral hemorrhage. The incident raised concerns about the quality of pre- hospital emergency services. This paper attempts to analyze the legal personality of pre-hospital emergency care behavior and discuss the relationship between emergency centers and patients by starting from the incident itself, combined with the current legislative status in the field of pre- hospital emergency care in China, aiming at propose a new administrative supervision model to effectively improve the quality of pre-hospital emergency services.
