中小微企业跨境争议在线解决机制研究

Study on Online Dispute Resolution Mechanism for Cross-Border Disputes Involving Small and Medium Sized Enterprises

缺乏有效的争端解决机制已经成为数字经济时代下中小微企业从事跨境贸易的最主要挑战之一,对于可支配资源有限、抗风险能力弱的中小微企业而言更是如此。传统的纠纷解决方式难以满足中小微企业对于跨境争议解决服务的个性化需求。随着科技发展和各国的实践探索,在线纠纷解决机制(ODR)凭借其高效、灵活、便捷、低廉的比较优势在跨境争议解决领域表现出蓬勃的发展态势和巨大潜力。同时,ODR也能够较好地与国际上现有的法律框架进行衔接。今后中小微跨境争议在线解决机制的发展可从优化平台建设,贴合中小微企业解纷需求;加强国际合作,促进ODR协作框架;促进多方联动,提高ODR可接近性三方面对该机制进行完善。

The lack of effective dispute resolution mechanism has become one of the main challenges for small and medium-sized enterprises engaged in cross-border trade in the digital economy era, especially for small and medium-sized enterprises with limited resources and weak risk resistance. Traditional dispute resolution methods are hart to meet the personalized needs of small and medium-sized enterprises (SMEs) for cross-border dispute resolution. With the development of technology and practical exploration in various countries, online dispute resolution mechanisms (ODR) have shown a thriving development trend and huge potential in the field of cross- border dispute resolution because of their comparative advantages of efficiency, flexibility, convenience, and affordability. At the same time, ODR can also better connect with existing international legal frameworks. In the future, the development of Msmes cross-border online dispute resolution mechanism can be improved from the following three aspects: optimize the platform construction to meet the needs of Msmes to resolve disputes;strengthening international cooperation and promoting the ODR collaboration framework;promoting multi-party interaction and improve the accessibility of ODR.
