摘要
虚拟数字人处于快速发展阶段,当前技术已经可以实现虚拟数字人的表演行为,关于虚拟数字人的表演是否值得保护以及如何进行保护的问题,值得进行探讨。虚拟数字人处于静态与动态时,权利客体与保护方式也不同,也需确定权利归属。综合考虑虚拟数字人、真人表演者和开发设计者几个主体实际发挥的作用,从而对虚拟数字人表演的著作权相关权利进行更好的保护,又不至与当前法律规定与价值取向相违背。在虚拟数字人表演相关权利能够得到保护的同时,也须注意权利行使的边界,真正发挥著作权法对作品及作者利益的保护。
The legal academic scenario of virtual digital humans is currently in a stage of rapid development. The current technology can already enable virtual digital humans to perform, and it is worth exploring whether and how their performances should be protected. The rights object and protection methods differ between static and dynamic virtual digital humans, and the ownership of rights needs to be determined. By considering the actual roles played by virtual digital humans, the performers, and the designers, a better protection of the copyright-related rights of virtual digital human performances can be achieved without contradicting current legal provisions and value orientations. While the relevant rights of virtual digital human performances can be protected, it is also necessary to pay attention to the boundaries of rights exercise to truly fulfill the role of copyright law in protecting works and the interests of authors.
