京津冀知识产权案件集中管辖路径探析

Analysis of the Centralized Jurisdiction Path of Intellectual Property Cases in the Beijing-Tianjin-Hebei Region

为促进京津冀知识产权案件“同案同判”,保护知识产权人的利益,助力京津冀知识产权协同创新发展,有必要探索京津冀知识产权案件集中管辖路径。考虑到目前我国知识产权案件专门化、集中化管辖趋势,坚持两便原则,利用京津冀现有的智慧法院建设成果,结合京津冀各法院针对知识产权司法保护已经开展的探索,京津冀知识产权案件集中管辖具有充分的可行性。在具体制度构建时,需要充分考虑地域性、审判能力、管辖现状等因素,在保持知识产权案件一审地域管辖不变的情况下,由北京知识产权法院集中管辖京津冀知识产权二审案件,以促进京津冀知识产权案件的一致性保护,促进京津冀的协同发展。In order to promote the “like cases should be treated alike” of intellectual property cases in the Beijing-Tianjin-Hebei region, protect the interests of intellectual property owners, and facilitate the coordinated innovation and development of the Beijing-Tianjin-Hebei region, it is necessary to explore the centralized jurisdiction path of intellectual property cases in the Beijing-Tianjin-Hebei region. Considering the current trend of specialization and centralized jurisdiction of intellectual property cases in China, adhering to the principle of facilitating litigants’ litigation and courts’ exercise of judicial power, making use of the existing achievements of the construction of smart courts in the Beijing-Tianjin-Hebei region, and combining with the exploration of judicial protection of intellectual property rights in the Beijing-Tianjin-Hebei region, the centralized jurisdiction of intellectual property rights cases in the Beijing-Tianjin-Hebei region is fully feasible. When constructing specific systems, it is necessary to fully consider factors such as regionalism, judicial capacity, and current jurisdictional status. Under the condition of keeping the regional jurisdiction of the first instance of intellectual property cases unchanged, the Beijing Intellectual Property Court will centralize the second instance of the Beijing-Tianjin-Hebei region intellectual property cases, so as to promote the consistent protection of intellectual property cases in the Beijing-Tianjin-Hebei region and promote the coordinated development of the Beijing-Tianjin-Hebei region.
