摘要
随着人口老龄化加剧,退休返聘现象愈发普遍。然而,我国退休返聘人员权利保障面临诸多困境,包括同工同酬、经济补偿、工伤认定等。本文通过对退休返聘人员的内涵及性质进行界定,深入分析其权利保障的困境,并提出完善我国退休返聘人员权利保障的进路,包括清晰界定退休返聘人员的法律地位、建立适合退休返聘人员的经济补偿机制、适度扩大工伤认定范围以明确风险分担等。完善退休返聘人员权利保障制度具有重要现实意义,有助于保障其合法权益,发挥人力资源优势,促进社会经济可持续发展。With the intensification of population aging, the phenomenon of retirement and rehiring is becoming increasingly common. However, the protection of the rights of retired and rehired personnel in China faces many challenges, including equal pay for equal work, economic compensation, and work-related injury recognition. This article defines the connotation and nature of retired and rehired personnel, analyzes in depth the difficulties in protecting their rights, and proposes ways to improve the protection of the rights of retired and rehired personnel in China, including clearly defining the legal status of retired and rehired personnel, establishing an economic compensation mechanism suitable for retired and rehired personnel, and moderately expanding the scope of work-related injury identification to clarify risk sharing. Improving the rights protection system for retired and rehired personnel has important practical significance, which helps to safeguard their legitimate rights and interests, leverage their human resource advantages, and promote sustainable socio-economic development.
