The Temporary Measures System for Commercial Arbitration in China and Its Improvement

近年来中国在商事仲裁领域呈现繁荣发展的趋势,但许多亟待完善的问题也随之出现。《仲裁法修改征求意见稿》体现了许多我国商事仲裁领域的热点问题,其中临时措施制度属于改动较大的部分。文章从我国商事仲裁临时措施领域出发,通过分析我国在商事仲裁领域的现存问题,提出对中国商事仲裁临时措施制度的完善建议。In recent years, China has seen a trend of prosperous development in commercial arbitration, but many problems that need to be improved have also emerged. The draft amendment to the Arbitration Law reflects many hot issues in China’s commercial arbitration field, and the temporary measures system is one of the parts that have undergone significant changes. This paper starts from the field of temporary measures in commercial arbitration in China and, by analyzing the existing problems in China’s commercial arbitration field, comparing international practices and combining China’s recent development status, it puts forward suggestions for the improvement of China’s commercial arbitration temporary measures system.
