电子商务平台之义务及责任边界厘定

摘要 《电子商务法》实施五年以来,有机平衡了促进发展、规范秩序与保障权益间的关系,但对于平台经营者应当履行的义务及所承担的有限责任之介分,在理论界和实务界仍各执其词。主要争议焦点为第38条第2款中资质资格审查义务和安全保障义务之具体内容、履行程序以及“相应责任”之内容、归责原则、举证责任分配、权利义务主体。文章运用对比分析法,立足于平台、平台内经营者及消费者三方之利益平衡角度,对《电子商务法》第38条两款适用关系亟需释明的一些导致“同案不同判”的法律适用问题边界展开探讨并厘定电子商务平台之义务与责任边界,希冀能在对其逻辑结构拆解分析后,厘清其实务应用困境之理论要件及法律后果,为《电子商务法》之更好地适用提供一些参考。 Since the implementation of the E-Commerce Law five years ago, it has effectively balanced the relationship between promoting development, regulating order, and protecting rights and interests. However, there are still different opinions in both theoretical and practical circles regarding the obligations that platform operators should fulfill and the limited liability they undertake. The main focus of controversy is the specific content, performance procedures, corresponding responsibilities, attribution principles, allocation of burden of proof, and subject rights and obligations of qualification review and security protection obligations in article 38, paragraph 2. The article uses comparative analysis method, based on the perspective of balancing the interests of the platform, platform operators, and consumers, to explore the boundaries of legal application issues that urgently need to be clarified in the application relationship of article 38 (2) of the E-Commerce Law, which leads to “different judgments in the same case”, and to clarify the obligations and responsibilities of e-commerce platforms. It is hoped that after dismantling and analyzing their logical structure, clarify the theoretical elements and legal consequences of its practical application dilemma, and provide some reference for the better application of the E-Commerce Law.
