电子商务平台在线纠纷解决机制优化路径研究

摘要 我国电子商务领域发展迅速,消费纠纷的数量也与日俱增,但是传统纠纷解决方式已无法满足当前电子商务纠纷的解决需求,因此,在线纠纷解决机制应运而生。在线纠纷解决机制具有成本低、效率高、节约司法资源的优势,但是在实践中仍然处于摸索阶段,需要不断完善。本文探究电子商务平台在线纠纷解决机制的现实短板,提出针对性的建议,通过巩固在线纠纷解决机制中立性、完善在线纠纷解决机制的法律规定及平台规则、优化在线纠纷解决机制的程序、提高纠纷处理结果的执行效率,加强大众对电子商务平台的信心,助力电子商务产业长远发展。 With the rapid development of Chinese e-commerce field, the number of consumer disputes is also increasing. However, the traditional dispute resolution methods can no longer meet the current needs of e-commerce dispute. Therefore, the online dispute resolution mechanism came into being. The online dispute resolution mechanism has the advantages of low cost, high efficiency and saving judicial resources, but it is still in the exploratory stage in practice and needs to be continuously improved. This paper explores the practical shortcomings of the online dispute resolution mechanism of the e-commerce platform, and puts forward targeted suggestions. By consolidating the neutrality of the online dispute resolution mechanism, improving the legal provisions and platform rules of the online dispute resolution mechanism, optimizing the procedures of the online dispute resolution mechanism, improving the efficiency of the implementation of the dispute resolution results, we can strengthen the public’s confidence in the e-commerce platform, which can help the long-term development of the e-commerce industry.
