电子商务平台经营者责任认定研究

Research on the Responsibility Identification of E-Commerce Platform Operators

随着互联网经济的迅速发展,电子商务发展进程逐渐加快,但由于法律的制定具有滞后性,以及电子交易过程中所涉及的主体数量众多,由此出现了平台经营者责任认定的难题。本文在对电子商务平台经营者的内涵和责任进行阐述的同时,指出了在电子商务发展过程中平台主体可能出现的问题。最后在对问题进行分析的情况下,提出了从明确“相对责任”的性质以及举证责任倒置的解决对策,以期能够解决司法实践中电商平台经营者责任认定问题。

With the rapid development of the Internet economy, the development process of e-commerce has gradually accelerated, but due to the lag in the enactment of laws and the large number of subjects involved in the process of electronic transactions, the problem of determining the responsibility of platform operators has emerged. This paper expounds the connotation and responsibility of e-commerce platform operators, and points out the problems that may occur in the course of e-commerce development. Finally, in the case of the analysis of the problem, the author puts forward solutions from clarifying the nature of “relative responsibility” and the inversion of the burden of proof, in order to solve the problem of determining the responsibility of the operator of the e-commerce platform in judicial practice.
