电子商务平台经营者对消费者侵权责任的分析探讨

摘要 《电子商务法》明确要求电子商务平台经营者负有对内部经营者的形式审查义务和确保消费者人身和财产安全的义务。然而实践中,存在相关法条解释空间大,具体内容和界限模糊不清的困境,一定程度上导致了电子商务平台的无序发展,也造成了法律适用的混乱,造成同案不同判的现象,有损司法的公平正义。文章通过对相关法律原则、电子商务平台的法律地位与责任承担进行分析、从未尽审查义务和未尽安全保障义务两个方面分别阐述影响电子商务平台经营者承担责任的因素,进而提出一系列管理和控制侵权责任的建议,以促进电子商务的健康发展。 The E-commerce Law clearly requires e-commerce platform operators to have the obligation to review the form of internal operators and ensure the personal and property safety of consumers. However, in practice, there is a dilemma that the interpretation space of relevant laws is large, and the specific content and boundaries are ambiguous, which leads to the disorderly development of e-commerce platforms to a certain extent, and also causes confusion in the application of laws, resulting in different judgments in the same case, which damages judicial fairness and justice. By analyzing the relevant legal principles, the legal status and liability of e-commerce platform, and the factors that affect the liability of e-commerce platform operators from two aspects: never doing the review obligation and not doing the security obligation, the paper puts forward a series of suggestions on the management and control of infringement liability, so as to promote the healthy development of e-commerce.
