摘要
本文提出电子商务中消费者隐私权的保护是重要的,并列举了电子商务模式下侵犯消费者隐私权的若干具体形式。然而,在个人隐私权的保护和电子商务经济发展的效率之间存在着一定的紧张关系,本文借助于应用伦理学的思想和方法来确立一系列伦理原则,企图消解两者之间的这种紧张。这些原则包括透明性原则、目的明确原则、安全性原则、公正性原则、负责性原则等。本文认为,遵循上述原则,既有利于消费者隐私权的保护,又能促进电子商务行业的持续健康发展,从而推动实现隐私保护和经济效益的双赢局面。
This paper suggests that the protection of consumer privacy in electronic commerce is important and enumerates a number of specific forms of violations of consumer privacy in the electronic commerce paradigm. However, there is a certain tension between the protection of individual privacy rights and the efficiency of the economic development of e-commerce, and this paper draws on the ideas and methods of applied ethics to establish a series of ethical principles in an attempt to dissolve this tension between the two. These principles include the principle of transparency, the principle of clarity of purpose, the principle of security, the principle of fairness, the principle of accountability and so on. This paper argues that following the above principles is conducive to both the protection of consumer privacy and the sustainable and healthy development of the e-commerce industry, thus promoting the achievement of a win-win situation in terms of privacy protection and economic benefits.
