在电子商务平台中,网络刷单行为通过对商品进行好坏的评价,影响店铺信誉与竞争力的同时,损害了电子商务平台的经营秩序。网络刷单行为不仅冲击传统的诚信经营观念,阻碍了新兴的网络经济市场的健康发展,还滋生了其他网络违法犯罪活动。理论界和司法界对网络刷单行为的认定展开了深入探究,但因缺乏专门立法规定,对网络刷单行为究竟以何种罪名追究刑事责任仍然存在较大争议。通过明确网络刷单行为的概念,分析刑法规制其的正当性和必要性。现行立法缺乏相关针对性罪名,司法实践中对适用何种罪名存在相当争议。应坚持刑法解释论的方法,对已有罪名的构成要件进行扩大解释,将相关网络刷单行为纳入刑法规制范围。同时通过完善前置法规,分而治之,推动电商平台的规范发展。

In the e-commerce platform, the online brushing behavior affects the reputation and competitiveness of the store by evaluating the quality of the goods, while damaging the business order of the e-commerce platform. Network brushing not only impacts the traditional concept of honest management, hinders the healthy development of the emerging network economic market, but also breeds other network illegal and criminal activities. The theoretical and judicial circles have carried out in-depth research on the identification of Internet brushing behavior, but due to the lack of special legislative provisions, there is still a great dispute on what kind of charges should be used to pursue the criminal responsibility of Internet brushing behavior. This paper analyzes the legitimacy and necessity of the criminal law regulation by clarifying the concept of the act of Internet brushing. There is a lack of relevant targeted charges in the current legislation, and there is quite a dispute about which charges should be applied in judicial practice. We should adhere to the method of criminal law interpretation, expand the interpretation of the constitutive elements of the existing charges, and bring the relevant Internet brushing into the scope of criminal law regulation. At the same time, through improving the pre-regulation, divide and rule, promote the standardized development of e-commerce platforms.
