摘要
随着网络平台技术的更新,刷新了新网购时代的世界,使得网络购物在我国迅速普及,网络购物因其便捷性、性价比高等特点受到消费者的青睐。这种方便的渠道给消费者带来方便的同时,也带来了原来消费者知情权的保护面临了新的问题。一方面,网购不受时间、空间限制,确实存在一定便捷性;另一方面,网络的虚拟性、技术性,让网购消费者的权益更易受到侵害,消费者弱势地位极为显著。本文首先阐述了网购消费者知情权基本理论的基础,然后从网购经营者和消费者,立法者和执法者角度分析了我国电子商务消费者知情权保护存在的问题,并就这些问题对未来我国网购消费者知情权如何更好地完善提出一些建议。
With the update of network platform technology, the world of the new online shopping era has been refreshed, making online shopping rapidly popularized in China. Online shopping is favored by consumers because of its convenience and high cost performance. This convenient channel brings convenience to consumers, but also brings the protection of consumers’ right to know faces new problems. On the one hand, online shopping is not limited by time and space, and there is some convenience;on the other hand, the virtual and technology of the network make the rights and interests of online shopping consumers more vulnerable, and the weak position of consumers is extremely significant. This paper first expounds the basis of the basic theory of online consumers’ right to know, and then from the online operators and consumers, legislators and law enforcers perspective analyzes the problems of electronic commerce consumers’ right to know protection, and these problems for the future of China online shopping consumers’ right to know how to better perfect put forward some Suggestions.
