Research on Administrative Law Regulation of E-Commerce Platform Network Live Broadcast Carrying Goods

电商平台网络直播促进文化与知识的传播、带动就业发展,创造无数的财富奇迹,推动实体经济的发展,但与此同时也出现了引导青少年价值观走向扭曲、侵犯个人隐私权与平台数据造假等社会问题。导致上述问题频频发生,行政规制缺乏是网络直播平台不作为的根本原因。文章先是分析关于电商平台网络直播的立法现状,再对电商平台直播法律监管问题进行检视,研究发现存在关于网络直播行政法规制理念相对滞后,规制网络直播的部门众多以至于行政主体职权分散,传统的行政执法模式导致监管手段粗放,缺乏相关的专门法进行规制等问题,鉴于此,本文从更新行政规制理念、明确行政主体职责,细化监管、健全规制网络直播行政法规范三个层面出发,提出了规范电商平台网络直播的行政法规制路径,以解决以上问题。

Online live broadcast on e-commerce platforms promotes the spread of culture and knowledge, drives employment, creates countless miracles of wealth, and promotes the development of the real economy. However, at the same time, social problems such as distorting teenagers’ values, violating personal privacy and platform data fraud also appear. The lack of administrative regulation is the root cause of the inaction of network live broadcast platforms, this causes the above problems to occur frequently. The article first analyzes the legislative status of online live broadcast on e-commerce platforms, and then reviews the legal supervision of online live broadcast on e-commerce platforms. It finds that the concept of administrative law regulation on online live broadcast is relatively backward, there are many departments regulating online live broadcast, so that the powers of administrative subjects are scattered, the traditional administrative law enforcement model leads to extensive regulatory means, and the lack of relevant special laws to regulate. In view of this, starting from three levels: updating the concept of administrative regulation, clarifying the responsibilities of administrative subjects, refining supervision, and improving the regulation of network broadcast administrative law, this paper puts forward the regulation path of administrative law regulating network live broadcast on e-commerce platforms to solve the above problems.
