网络购物中消费者知情权保护研究

摘要 互联网技术的发展,使得网络购物在我国快速普及,网络购物如同一把双刃剑,使网络购物在为消费者带来了极大便利的同时,因网络的虚拟性和复杂性,也产生了诸多法律问题。本文从网络购物消费者知情权的内涵入手,阐述了在网络购物中消费者知情权保护的必要性,分析了当前网络消费者知情权法律保护的现状及困境,发现目前网络购物中消费知情权面临着法律规范滞后、执法效率不高、监管力度不足、经营者虚假宣传等问题,最后分别从立法、执法、司法、经营者和消费者等主体出发提出相关保护建议,促进网络消费市场的健康发展。 The development of Internet technology has made online shopping rapidly popular in China, and online shopping is like a double-edged sword, which has brought great convenience to consumers at the same time, but also caused many legal problems due to the virtuality and complexity of the network. Starting from the connotation of consumers’ right to know in online shopping, this paper expounds on the necessity of protecting consumers’ right to know in online shopping, analyzes the current situation of legal protection of online consumers’ right to know, and finds that the current consumer right to know in online shopping is facing problems such as lagging legal norms, low law enforcement efficiency, insufficient supervision, and false publicity by operators. Finally, it puts forward relevant protection suggestions from the perspectives of legislation, law enforcement, justice, operators and consumers to promote the healthy development of online consumer market.
