电子商务平台中劳动者权益保护问题探究

Inquiry into the Protection of Workers’ Rights and Interests in E-Commerce Platforms

随着互联网技术的迅猛发展,依托信息技术发展起来的商务平台成为促就业、惠民生的重要途径。现阶段,由于平台用工灵活性导致现行法律对平台劳动者无法提供有效保护。由于立法滞后等原因,我国平台经济劳动者保护陷入很大困境,主要表现为劳动关系难以认定,劳动者缺乏劳动安全和社会保障。本文通过分析电子商务平台的快速发展中企业用工的特点,劳动者的权益保护困境以及造成困境的成因等方面。从我国国情和特有特点出发,可通过优化完善我国现有的劳动关系认定模式、探索新型工会组织形式以及构建完善的社会保障体系等举措,打造多维度、多层次、多领域的电子商务平台劳动者权益维护新格局。With the rapid development of Internet technology, business platforms developed on the basis of information technology have become an important means of promoting employment and benefiting people’s livelihoods. At the present stage, the flexibility of platform employment has resulted in the inability of existing laws to provide effective protection for platform workers. Due to the lagging legislation and other reasons, the protection of workers in China’s platform economy is in a great dilemma, which is mainly manifested in the difficulty of identifying the labour relationship and the lack of labour safety and social security for the workers. This paper analyses the characteristics of labour employment in the rapid development of e-commerce platforms, the difficulties in the protection of workers’ rights and interests, and the causes of these difficulties. From the perspective of China’s national conditions and unique characteristics, we can optimize and improve China’s existing mode of identifying labour relations, explore new forms of trade union organization, and build a complete social security system to create a new pattern of safeguarding the rights and interests of workers on e-commerce platforms in a multi-dimensional, multi-level and multi-disciplinary manner.
