在数字经济时代,信息技术的飞速发展带来了前所未有的便利,同时也加剧了个人隐私权保护的挑战。本文旨在探讨数字经济背景下个人隐私权的保护问题。首先,本文分析了数字经济与隐私保护挑战的加剧以及公众隐私安全意识的觉醒。其次,探讨了欧盟和美国的立法保护模式,并从立法、执法、司法三个层面论述了我国隐私权法律保护的现状。在此基础上,本文深入分析了当前隐私权保护面临的主要问题,包括个人数据泄露风险、立法及其实践问题、以及用户隐私意识不足等。最后,本文提出了在数字经济背景下隐私权保护的法律路径探索,特别是在构建数据共享与个人隐私保护平衡、明确个人信息权益保护边界、以及强化隐私权法律保护意识宣传等方面提出了具体建议。In the era of digital economy, the rapid development of information technology has brought unprecedented convenience, while also intensifying the challenge of personal privacy protection. This article aims to explore the protection of personal privacy rights in the context of the digital economy. First, this article analyzes the intensification of digital economy and privacy protection challenges and the awakening of public privacy and security awareness. Secondly, it discusses the legislative protection models of the European Union and the United States, and discusses the current status of legal protection of privacy rights in my country from three levels: legislation, law enforcement, and justice. On this basis, this article provides an in-depth analysis of the main issues currently facing privacy protection, including the risk of personal data leakage, legislative and practical issues, and insufficient user privacy awareness. Finally, this article proposes an exploration of legal paths for privacy protection in the context of the digital economy, especially providing the specific suggestion in terms of establishing a balance between data sharing and personal privacy protection, clarifying the boundaries of personal information rights protection, and strengthening the awareness of legal protection of privacy rights.
