电商领域消费者个人信息保护研究

摘要 目前,我国电子商务的发展已经全面进入3.0时代,电商行业在大数据、云计算等算法的推动下快速发展。电商行业的快速发展离不开消费者个人信息的助力作用,消费者个人信息成为助力各大电商产业发展的重要资源。消费者个人信息对电商平台而言,蕴含巨大的商业价值,但电商行业依靠信息资源提高经济效益的同时,由于缺乏有效的法律规制致使消费者个人信息权被侵害的乱象频发,电商平台过度收集、泄露消费者个人信息等问题亟待解决。实践中,消费者个人信息保护存在平台与消费者之间对话难、监管机制不健全、消费者维权难、消费者个人信息类型化保护机制缺失等困境。对此可以通过拓宽平台与消费者之间的对话路径、完善消费者个人信息保护的监管机制、推行个人信息保护的公益诉讼、建构消费者个人信息的区分保护模式等手段,实现对消费者个人信息的有效保护。At present, the development of China’s e-commerce has fully entered the 3.0 era, and the e-commerce industry is developing rapidly under the promotion of big data, cloud computing and other algorithms. The rapid development of the e-commerce industry cannot be separated from the role of consumer personal information, and consumer personal information has become an important resource to help the development of major e-commerce industries. Consumer personal information contains huge commercial value for e-commerce platforms, but while the e-commerce industry relies on information resources to improve economic benefits, due to the lack of effective legal regulations, consumers’ personal information rights are frequently infringed chaos, e-commerce platforms excessive collection, disclosure of consumer personal information and other problems need to be solved. In practice, consumer personal information protection has difficulties in the dialogue between the platform and consumers, the supervision mechanism is not perfect, the consumer rights protection is difficult, and the consumer personal information type protection mechanism is missing. In this regard, the effective protection of consumers’ personal information can be achieved by broadening the dialogue path between the platform and consumers, improving the supervision mechanism for consumer personal information protection, promoting public interest litigation for personal information protection, and constructing a differentiated protection model for consumer personal information.
