实践之中,电子商务平台经营者可以分为两类,第一是为电子商务平台内经营者和消费者提供媒介服务的第三方,第二是自己直接为消费者提供商品或服务的自营者。两者的法律地位不一样,其侵权所需承担的责任也不一样。前者作为提供媒介服务的第三方,其需要履行的义务主要是资格审核义务和安全保障义务,主要目的在于维护交易安全。提供媒介服务的电子商务平台经营者充当的是辅助者和监管者的角色,承担的侵权责任往往与平台内经营者密切相关。后者开展自营业务,其法律地位相当于商品销售者或服务提供者,且应当以显著方式予以区分标记,不得误导消费者。开展自营业务的电子商务平台经营者的侵权责任直接与自营业务相关,销售商品和提供服务分别承担不同的侵权责任。In practice, e-commerce platform operators can be divided into two categories: the first is the third party who provides media services for the operators and consumers within the e-commerce platform;the second is the self-operator who directly provides goods or services for consumers. The legal status of the two is not the same, and the liability for infringement is also different. As a third party providing media services, the former needs to fulfill the obligations of qualification review and security obligations, the main purpose is to maintain the security of transactions. E-commerce platform operators who provide media services play the role of assistant and regulator, and the infringement liability they bear is often closely related to the operators within the platform. The latter carries out its own business, its legal status is equivalent to that of a seller of goods or a service provider, and it should be marked in a prominent way and not mislead consumers. The infringement liability of e-commerce platform operators who carry out self-operated business is directly related to self-operated business, and the sale of goods and the provision of services bear different infringement liabilities respectively.
