法律典籍专业术语翻译中的文化再现——以《唐律疏议》为例

Cultural Reproduction in the Translation of Professional Terms in Legal Classics—Taking “Tang Code” as an Example

与现代法律专业术语相比,汉英法律典籍翻译中的一个难题在于如何正确地理解和表述法律专业术语,这不仅需要在语言上达到对等的作用,而且还需要在法律的作用上达到对等。中华法律制度的特殊性、中西思维方式的差异以及古代法律专业名词的历史特征,是制约古代法律专业术语翻译的重要因素。翻译古代法律典籍是弘扬中国古代法学文化和优秀传统文明的重要方式。在这类典籍的翻译中,既要做到保持原文的原汁原味,又要充分体现其深刻的思想内涵和民族特征,又要防止由于语言和文化的不同而造成的歧义和错误。《唐律疏议》是中国古代最高的法治理念的集合,蕴含着极其丰富的古代法律思想和文化。本论文以《唐律疏议》为例,通过对其中法律典籍术语的考察,探讨了中国传统法律术语在英译过程中所遇到的难点及相应的翻译对策。

Compared with modern legal professional terms, a difficult problem in the translation of Chinese and English legal classics lies in how to correctly understand and express legal professional terms, which requires equivalence not only in language, but also in law. The particularity of the Chinese legal system, the difference between Chinese and Western ways of thinking and the historical characteristics of the ancient legal terms are the important factors that restrict the translation of ancient legal terms. The translation of ancient legal books is an important way to carry forward the ancient Chinese legal culture and excellent traditional civilization. In the translation of such classics, we should not only maintain the original flavor of the original text, but also fully reflect its profound ideological connotation and national characteristics, and prevent the ambiguity caused by the difference of language and culture. As a collection of the highest ideas of the rule of law in ancient China, “Tang Code” contains extremely rich ancient legal thoughts and culture. This paper takes “Tang Code” as an example, through the investigation of the terms of legal classics in it, discusses the difficulties encountered in the process of translating traditional Chinese legal terms into English and corresponding translation countermeasures.
